Surya-Landmark Developers Private Limited (CIRP)

The Hon’ble National Company Law Tribunal, Mumbai Bench vide its order dated December 02, 2021, ordered for commencement of Corporate Insolvency Resolution Process (“CIRP”) against M/s Surya-Landmark Developers Private Limited by admitting the application (C.P No. (IB) 348/MB/C-II/2020) filed by Financial Creditor under Section 7 of the Insolvency and Bankruptcy Code, 2016. Accordingly, the CIRP has commenced with effect from December 2, 2021.

The Hon’ble NCLT vide the same order appointed Mr. Prakul Thadi as the Interim Resolution Professional (“IRP”) to manage the affairs, business, and property of Surya-Landmark Developers Private Limited.

Claim Forms

The creditors of Surya-Landmark Developers Private Limited are hereby called upon to submit their claims with proof on or before December 18, 2021, to the IRP on the email id cirp.suryalandmark@gmail.com. The following forms are prescribed by the Insolvency and Bankruptcy Board of India in IBBI (Insolvency Resolution Process for Corporate Persons) Regulations, 2016. Accordingly, the creditors are advised to fill their respective forms based on their nature of debt and submit the same to the IRP.

Details of Authorised Representatives

On examination of the books of account and other relevant records of the corporate debtor, it is ascertained by IRP that the Corporate Debtor has a class of creditors, i.e., “Allottees under Real Estate Project”. Accordingly, for the representation of such creditors in a class, the IRP has identified the following three insolvency professionals who have given their consent to act as Authorised Representative of class of creditors, i.e., allottees under real estate project.

All the allottees under real estate project are hereby requested to indicate their choice of an insolvency professional, from amongst the following three choices provided by the IRP in the public announcement, to act as authorised representative of allottees. The insolvency professional, who is the choice of the highest number of financial creditors in the class in Form CA shall act as the authorised representative of the creditors of the respective class, i.e., allottees under real estate project. A brief profile of the respective insolvency professional is also provided below:
